Evidence Act, 1872–Sec. 27–Scope–For an information u/s. 27 of the Act to be admitted in evidence, the police officer concerned must depose the contents thereof verbatim during his sworn testimony–If the Investigation Officer fails during his testimony to elaborate the details of the information given to him by the accused u/s. 27 of the Act, a formal marking of the memorandum as an exhibit would not fulfill the requirement of law and the information would have to be treated as not proved.
