Penal Code, 1860–Sec. 494–Sentence of imprisonment till rising of Court–First accused had filed a petition seeking interim maintenance in the divorce proceedings and the Court had ordered to appellant to pay Rs. 5,000/- per month as maintenance–She received maintenance till 13.07.2017–Further, evidence that a child was born to the first and second respondent in their wedlock–Thereafter, she herself filed the petition for dissolution of marriage–While awarding the sentence, undeserving leniency was shown in the instant case–But the child is now aged only about six years, the sentence of six months to each accused would be appropriate.
