Code of Civil Procedure, 1908–Sec. 96–First appeal is the valuable right of the appellant–All the questions of facts and law decided by trial Court should be taken into consideration by the first appellate Court–This aspect was not kept in mind while dealing with the first appeal–Order set aside and matter remanded back.
