Jaipur Development Authority Act, 1982–Cancellation of lease deed–Appeal against–Dismissed by JDA Tribunal–Case of violation of conditions of lease deed–A perusal of the allotment order and lease deed indicated that 40 acres land was allotted to petitioner for the purpose of establishment of Golf Course and Golf Academy–It was not to be used for other purposes–As per condition no. 2, petitioner was not allowed to give the allotted land and building constructed thereon to anybody on sublease permanently or temporarily–As per condition no. 10, the land could not have been transferred for any other kind of mortgage/pledged rent etc. without prior approval of allotment authority–Petitioner not only violated the conditions but also raised a five-star hotel and Golf Studio after mortgaging the land–Held, Tribunal rightly upheld the order of cancellation of lease deed.
