Code of Criminal Procedure, 1973–Sec. 439–Narcotic Drugs & Psychotropic Substances Act, 1985–Secs. 8/21, 22, 25 & 29–Bail–Recovery of 23,750 tablets of Tramadol Hydrochloride from the conscious possession–Petitioners are in custody for last more than three years and six months–Delay in trial is not attributable to them–No material is available on record to show that their release would create a ruckus in the society or they will hamper the evidence of prosecution in any manner–Bail is granted subject to certain conditions, however, if any attempt to delay the trial is made by the petitioners, the prosecution will be free to move an application seeking the cancellation of the bail.
