Rajasthan Public Trust Act, 1959–Secs. 23(1) & (2)–Subsequent alterations of the bylaws by R–Validity–As per Sec. 23(1), the working trustee is mandated to report any change occurred in the entries of the record to the Assistant Commissioner within a perod of 90 days from the date of said change–The changes in the rules and regulations of the administration of the Trust were not notified to Asst. Commissioner–These amended bylaws do not create an estoppel in continuing the practice of appointment of Mahant by the State–Furthermore, pursuant to the demise of the erstwhile working trustee i.e., R, an application u/s. 41 ought to have been filed for appointment of new working trustee–Alteration in bylaws is declared to be void ab initio.
