Rajasthan Imposition of Ceiling on Agricultural Holdings Rules, 1973–Rule 17(4)–Rajasthan Tenancy Act, 1955–Sec. 225–356 bigha land was resumed under the ceiling law and it was allotted to respondents under the provisions of Rules of 1970–Assessee filed the appeal against the ceiling proceedings which was allowed by RAA–Order became final as the revision against it was dismissed–Thereafter, he filed the appeal for cancellation of subsequent allotments made to respondents–Allowed by RAA–Revision petition before BOR–BOR allowed the same on the ground that only the Collector has jurisdiction to cancel the allotment of the land acquired under the Ceiling Act and RAA was not having jurisdiction of hear the appeal–Justification–Challenge made in appeal was not covered by the parameters as provided in Rule 17(4) of Rules of 1973–Petitioners were having only remedy of filing appeal u/s. 225 of R.T. Act–View taken by BOR is incorrect–Judgment passed by BOR deserves to be set aside.
