Penal Code, 1860–Secs. 302 & 201–Conviction Establishment–Appellant was residing with the deceased–After causing the death, the body was thrown in the lake–Presence of appellant at the lake was established by the location of his mobile phone–He himself identified the body of deceased–He himself admitted the company of deceased–No explanation in the statements u/s. 313 –He also failed to discharge the burden u/s. 106 of the Evidence Act–However, there is no intention for causing the murder as the appellant himself took the deceased to hospital–Held, he is liable to be convicted u/s. 304 Pt. II.
