Maintenance and Welfare of Parents & Senior Citizens Act, 2007–Maintenance and Welfare of Parents & Senior Citizens Rules, 2010–Constitution of India, 1950–Art. 227–Intra-court appeal–Maintainability–As per provisions of Act and Rules, Maintenance Tribunal constituted u/s. 7 of the Act for deciding the matters regarding the maintenance and welfare of parents and senior citizens guaranteed and recognized under the Constitution and for all matters connected therewith or incidental thereto are having all the trapping of the Civil Court and any order passed by those Maintenance Tribunals comes within the definition of judicial function similar to the functions discharged by Civil Court–Order can be challenged before the High Court by invoking its superintentence powers as provided under Art. 227 and against the order passed by learned Single Judge–No intra-court appeal is maintainable.
