Criminal Trial–Last seen–Witness of–Testimony–Reliability–PW 12 & PW 20 categorically stated that they conveyed the information to complainant as regard to seeing the accuseds before he lodged the FIR–However, there is no whisper in FIR as regard to this important fact–Only the suspicion was raised in FIRs that the accuseds might have caused the incident–Such casts the dark shadow of suspicion over the testimony of the last seen witnesses–Further, both the witnesses stated that they were present at the spot when the bodies were recovered–However, their statements were not recorded on same day–PW 20 is a chance witness and relative of deceased–Discrepancies and contradictions in his testimony–Held, evidence of last seen is liable to be discarded.
