Penal Code, 1860–Sec. 420–Trade & Merchandise Marks Act, 1958–Secs. 103 & 104–FIR for the offence–Food articles recovered from the possession of petitioner were not found to be adulterated or spurious–Allegation that he was trying to sell them off to the unknown customers and was cheating on them is negated–Offences u/ss. 103 & 104 are non-cognizable and cognizance can be taken only on the complaint in writing made by the Registrar, Trademarks–FIR is liable to be quashed.
