Penal Code, 1860–Sec. 493–Constitution of offence–Allegation upto effect that after the marriage was settled, the appellant no. 1 started visiting the house of complainant frequently and would mislead and instigate his daughter that the relation is final and only “feras” remain to be performed–On the day of incident, appellant took leave and enticed and instigated his daughter, took her to his room and promissing that she is being his wife, established physical relations–Essential ingrediants to constitute the offence u/s. 493 are found missing–Charge sheet qua the offence u/s. 493 is liable to be quashed.
