Penal Code, 1860–Secs. 419 & 420–Applicability–Averments up to effect that the husband of appellant took a sum of Rs. 5,00,000/- for getting the son of complainant employed–No allegation at all that the appellant induced the complainant to get the job and the amount of Rs. 5,00,000/- was given to her–Even if all the allegations taken at the face value are true, the essential ingredients of cheating are missing–Criminal proceedings against the appellant u/ss. 419 & 420 are liable to be quashed–Magistrate would proceed for the rest offences u/ss. 323, 504 & 506.
