Negotiable Instruments Act, 1881–Sec.142A(2)–Code of Criminal Procedure, 1973–Sec. 257–Both the cheques were for realization of the entire amount–Dishonour of first cheque–Case u/s. 138 was pending against the petitioner in Mumbai–Complaint was withdrawn on 01.08.2021–Second complaint was filed at Jaipur on 30.03.2021 against the same drawer of cheque–Submission that the withdrawal would be effective from the presentation of the petition is misconceived because withdrawal is subject to satisfaction of the Magistrate that there are sufficient grounds for permitting withdrawal as permitted u/s. 257 Cr.P.C.
