Penal Code, 1860–Sec. 306–Conviction–Sustainability–Deceased committed suicide by jumping into a well–Though the prosecution has proved the fact of harassment by the appellant yet any positive action on part of the accused proximate to the time of occurrence which led to the suicide could not be proved–Appellant is entitled to be acquitted from the charge.
