Code of Civil Procedure, 1908–Order 7, Rule 11–Hindu Marriage Act, 1955–Sec. 13(1)–Application with the objection as regard to the jurisdiction of the Court–Dismissal of–Averments in the plaint regarding the residence of parties at Abu Road have specifically been made–Court is to go through the averments made in the plaint for deciding the application–Whether the averments are correct or incorrect, cannot be considered at this stage–Plea of the petitioner that earlier, the joint application u/s. 13-B had been made at Udaipur, would be of no consequence for the purpose of deciding the application under Order 7, Rule 11–Interference declined but the objection raised by the petitioner goes to the roots of the case–Therefore, it would be appropriate to direct that the issue should be decided as a preliminary issue.
