Code of Civil Procedure, 1908–Order 7, Rule 11(e)–Rejection of plaint
on the grounds that the plaint was not signed by counsel, affidavit filed along with the plaint was not notarized and the duplicate copy of plaint was not signed by counsel–Reasons given are apparently beyond the scope of the provisions–Further, no objection was raised by defendants, however, trial Court rejected the plaint after hearing final arguments–Impugned order is unjustified and deserves to be set aside.
