Penal Code, 1860–Sec. 420–FIR for the offence–Sustainability–Opinion of Investigation Officer that the nature of transaction between the parties was predominantly of a civil nature–It cannot be discerned that there was any intention of cheating as the petitioners and complainant were involved in the transfer of shares and it was done by petitioner and for the same, the amount was transferred to petitioner–FIR deserves to be quashed.
