Code of Criminal Procedure, 1973–Secs. 70(2), 204 & 319–Penal Code, 1860–Secs. 306 & 120-B–While allowing the application u/s. 319 and issuing the process, Court below issued non-bailable warrant–Object of issuance of process is to ensure the presence of accused, however, summoning of petitioner by bailable warrant would have been batter than the non-bailable warrant–Warrant converted accordingly.
