Penal Code, 1860–Secs. 376(2)(n), 450 & 420–Charge framed for the offence–Respondent no. 2 clearly stated in her court statements that on the basis of false promise made by petitioner to marry, he committed rape with her and later on refused to marry her–Criminal misc. petition filed on behalf of petitioner has been dismissed as not pressed–Trial Court considered the entire facts and circumstances and, thereafter, framed the charge–Held, no error was commited in framing charge.
