Specific Relief Act, 1963–Sec. 12–Suit for specific performance of sale agreement–Dismissed–As per the terms of the agreement, N.O.C. was to be obtained u/s. 26 of Urban Land Ceiling Act–Both the parties filed the joint application for same–No explanation by the plaintiff for inaction after filing the application–Suit was filed after eight years–Plaintiff has not even issued a single notice to defendants asking for specific performance–He failed to show his readiness and willingness at least after the expiry of 60 days of filing the application and till the date of filing the suit–Held, the suit was rightly rejected.
