Penal Code, 1860–Secs. 302/34, 364, 201 & 323/149–Conviction–Proper Section–Appellants put the deceased forcibly in the vehicle and assaulted with hands–Neither any weapon was used nor any injury was caused on vital part of body–There was no intention for killing the deceased–Further, the appellants took the deceased at hospital for treatment, but between the way, he died–Held, conviction u/s. 302/34 deserves to be altered u/s. 304 Pt. II.
