Guardian & Wards Act, 1890–Sec. 12–Hindu Minority and Guardian-ship Act, 1956–Sec. 6–Scope–The custody of a child less than five years of age should be given to the mother until and unless it is proved that she has mental infirmity or physical inability to maintain the child–Child is one year of age–No incapacity on part of mother–Held, custody was rightly given to her–However, the father and grand-parents are liberty to visit the place of the respondent-mother to meet the child on every weekend.
