Penal Code, 1860–Secs. 420 & 406–Prayer for quashing the FIR with the contention that the matter pertains to a dispute of a civil nature–FIR has been lodged in the year 2015–Charges were framed and proceedings were ongoing–This Court is not inclined to entertain the petition on account of delay and laches–However, the issue of facts qua the nature of dispute (civil or criminal) will remain open for consideration before the Trial Court.
