Penal Code, 1860–Secs. 409 & 420–Scope for constitution of offence–If on account of closure of the commercial activity, any particular person, who is associated with such commercial venture, suffers loss, the same would not amount to commit an offence u/s. 420 or 406–Allegation upto effect that
the accused company stopped its flights but it did not inform the complainant who continued to book ticket and suffered the loss–offences u/ss. 420 & 406 are not made out–Proceedings are liable to be quashed.
