Code of Criminal Procedure, 1973–Sec. 457–Rajasthan Police Act, 2007–Sec. 38–Prayer for releasing the vehicles which were seized by the police treating the unclaimed property–Once an application has been filed before the Court informing about the vehicle being unregistered ownership of the claimant and he claims the said property, the provisions of Sec. 38 would automatically cease to apply and the provisions of Sec. 457 could not be avoided–Impugned order passed by the Magistrate is misconceived–Set aside and directed to release the vehicles subject to certain conditions.
