Code of Civil Procedure, 1908–Order 8, Rule 1 (A)(3)–Application under–Rejection–Justification–View of trial Court that, earlier order passed by it attained finality as the writ petition was dismissed against the order–Earlier order was passed as regard to confronting the witness with document–Writ petition was rendered infructuous because of death of witness–Petitioner’s application under Order 8, Rule 1 (A)(3) could not have been rejected in view of earlier order because in that order the said document was not sought to be produced–Impugned order passed by trial Court is liable to be quashed and set aside.
