Penal Code, 1860–Secs. 364-A & 120-B–Conviction–Appreciation of–proper sentence–Seven persons were awarded life imprisonment–Out of the three were acquitted by High Court–Plea of appellants that the offence is punishable u/s. 363 instead of Sec. 364–Sustainability–Strong evidence that the appellants demanded the ransom and threaten that the child will be killed if the demand is not fulfilled–Prosecution case was found established with the testimonies of PWs 3, 6 & 7–Held, conviction was justified–Fact that kidnapping did not result in the death of the victim has no significance–Awarded sentence does not deserve to be reduced.
