Code of Civil Procedure, 1908–Order 39, Rules 1 & 2–Order passed under the provision–Scope for interference–Interference can be made only in a situation where the appellate Court is satisfied that the trial Court has acted contrary to law or arbitrarily or that findings of trial Court are perverse or capricious, palpably incorrect and untenable–If the view taken by the trial Court is a possible view, the same is not required to have interfered with by the appellate Court.
