Fatal Accidents Act, 1855–Sec. 1–Compensation–Plea of appellant that the deceased and defendants ownself were negligent–Sustainability of plea–Deceased was cutting the trees in his field–PW 2 stated that a live electricity wire fell down when they were cutting the branches of fallen tree–Wire fell on the shoulder of deceased and he sustained the burn injuries on shoulder and a part of leg–He denied the suggestion that the babool tree was very large in size and it’s branches were touching the intact lectric lines through which the electric current was flowing–Plea taken by appellants is found falsified from their own witness who admitted that in the event of the branches of a tree coming into contact with the electric line, a fault would occur and the electricity supply would be automatically shut off–Awarded amount of compensation is also justified–Interference declined.
