Penal Code, 1860–Sec. 304 Pt. I & II–Determination of section–If the act is done with intention of causing death for such bodily injury, as is likely to cause death, then the offender is liable for Pt. I whereas if the act is done with the knowledge that it is likely to cause death but without any intention to cause death, then the offence would befall u/s. 304 Pt. II.
