Code of Criminal Procedure, 1973–Sec. 391–Negotiable Instruments Act, 1881–Sec. 138–Prayer for recording the additional evidence–Rejected–Appellant had examined the witness of the bank during the trial but he did not ask any question to said witness regarding the genuineness or otherwise of the signatures as appearing on the cheque in question–He could have procured a certified copy of his specimen signatures from the bank and a request could have been made to summon the concerned bank official in defence for giving evidence regarding the genuineness or otherwise of the signatures on the cheque–Held, there was no requirement for Appellate Court to exercise the powers u/s. 391.
