Specific Relief Act, 1963–Sec. 12–Limitation Act, 1963–Art. 54–Rejection of suit on the ground of barred by limitation–As per agreement, plaintiff were to deposit the due installments of land and, thereafter, the remainder of the consideration Rs. 1000/- was agreed to be paid within a month of payment of last installment simultaneously at the time of execution of sale deed–Last installment was paid on 8-1-1968–Time for performance was fixed–Further, there was no express condition requiring obtaining of the sanad by the defendants–Merely because the sanad was not obtained and defendant nos. 4 to 8 were minor, the period of limitation cannot be said to have been extended, particularly in absence of any such stipulation in agreement–Held, suit was rightly hold barred by limitation.
