Penal Code, 1860–Secs. 323, 353, 504 & 506–Criminal proceedings–Parties are related and are neighbours–Civil dispute regarding the property is pending–After the quarrel took place between the parties, police visited the spot and initiated the proceedings u/ss. 151, 107 & 116 Cr.P.C.–In the earlier complaint u/s. 156(3), trial Court disbelieved the second incident as alleged in the complaint which throws a shadow of doubt on the earlier part of the incident as alleged–Criminal proceedings are initiated with an ulterior motive due to private and personal grudge–Proceedings are liable to be quashed.
