Allotment of Land–Violation of conditions–Resumption of part of the land for the purpose of its allotment to another institute–Writ petition against–Dismissal of–In the earlier notice, it has been clearly mentioned that the appellant-society has violated the conditions–Appellant-society was aware about the fact of subletting because it furnished the explanation as regards to subletting in its reply–Plea of appellant that it is using 4 to 5 bigha land for the purpose of agriculture, is not acceptable because the land was to be used only for school–Raising of construction was at the own risk of appellant and it would not create any right in its favour–Land was allotted to impart selfless education but the appellant is charging the fees–Further, the appellant-society executed the agreement with other educational trust and both are separate entities–No permission was obtained for executing the agreement–Interference delined in the findings.
