Eviction Law–Bonafide necessity–Subsequent events–Crucial date for deciding bonafide necessity shown by the land-lord is the date of the suit/petition and it must also continue through out the progress of litigation and must exist on the date of decree of final Court but at the same time if during
the pendency of litigation subsequent developments and events happen and the land-lord comes into possession of vacant premises which is suitable and sufficient to satisfy the requirement of the land-lord and events or development may be taken note of to adjudicate the bonafide and reasonability of
the need shown by the land-lord–Such subsequent developments and events are to be taken only when the need of the land-lord can be shown to be completely eclipsed by such subsequent events.
