Penal Code, 1860–Secs. 304 & 304-A–Offence under both Sections–Distinction between–Held, Sec. 304 requires the existence of intention or knowledge whereas Sec. 304-A requires the existence of rashness or negligence–Section 304 deals with an act amounting to culpable homicide whereas Sec. 304-A deals with an act not amounting to culpable homicide.
