Mines & Minerals (Regulation & Development) Act, 1957–Sec. 15–Rajasthan Minor Mineral Concession Rules, 1977–Rule 62–Makrana Marble Rules, 1922–Rule 7–Transfer of bapi patta–Permissibility–Bapi rights are extinguished after commencement of Act of 1957 and they are governed by the Rule 62 of Rules of 1977–On the relevant day of transfer, AG & AS were having no declaration by the competent Court in favour of their bapi rights–Further, the sale deed was contrary to concept of muslim law–Further more, the findings of trial Court as regard to fact of possession is also found erroneous–Held, suit was wrongly decreed.
