Penal Code, 1860–Secs. 364-A & 420–Conviction–Sustainable against whom ?–No reliable and admissible evidence on record to connect the appellant J & K with the offence–Only the statement of PW-1 up to the effect that two persons ran away from the spot–Identity of these appellants could not be specified by the prosecution–Witness PW-11 also stated that he cannot identify the accused–Statements of A are hit by Sec. 25 and cannot be held admissible as these were not followed by recovery–Held, appellants J & A are entitled to be acquitted.
