Code of Civil Procedure, 1908–Order 21, Rule 90–Limitation Act, 1963–Sec. 5–Application for setting aside the sale on the ground of irregularity or fraud–Limitation for filing–Limitation of 60 days is provided in terms of Art. 127 of third Division, Part I of the Limitation Act–Sec. 5 of Limitation Act is not applicable to the proceedings under Order 21, Rule 90–Therefore, the delay if any, cannot be condoned u/s. 5 of Act.
