Industrial Disputes Act, 1947–Sec. 10–Reference–Rejection on the ground of failure in establishment of relationship of employer and workman–Justification–Petitioner was employed through contractor–He will be deemed to be a workman–Further, he produced the photocopy of logbooks containing the entries regarding his employment which were not controverted by the respondents–Tribunal committed error in not passing any order over this aspect–Impugned award set aside and matter remanded back to Tribunal to decide the dispute in regard to legality of termination.
