Evidence Act, 1872–Secs. 65 & 74–Registration Act, 1908–Sec. 61(2) –Scope–Originals of registered will, registered release deed as also the registered adoption deed must necessarily have been returned to be executants/beneficiaries as provided for by Sec. 61(2) of Registration Act–Photocopies of such documents kept with the sub-registrar cannot be termed as original–Such photocopies cannot pertake the character of public documents u/s. 74 of Evidence Act–The public record qua such registered documents would be the entries which are the original/primary ones in regard thereto in the statutory records of the transaction kept in the sub-registrar’s office–Aforesaid registers being primary evidence of public record, their certified copies would be covered by Sec. 65(e) of the Evidence Act.
