Code of Criminal Procedure, 1973–Sec. 439–Penal Code, 1860–Secs. 376D & 342–Grant of bail during the trial with the observation that there are contradictions between the FIR and statements of victim u/s. 164–Once, the trial commences, it should be allowed to reach its final conclusion which may either result in the conviction or acquittal of the accused–Bail can only be granted if the trial gets unduly delayed, and that too for no fault on the part of accused–In the instant case, the victim is to be examined–Her mother is eye-witness and she has also not been examined–Accused and victim belongs to the same village–Held, respondent-accused shall not enter the village till the completion of the trial–He shall furnish his new address to Investigation Officer.
