Damage–Public Premises (Eviction of Unauthorised Occupants) Act, 1971–Sec. 10–Suit for damage with claiming that the respondents illegally demolished the shops of the plaintiff–Decreed by the Trial Court–Justification–Plaintiff has not produced any evidence to show that the shops in question are not within the precincts of railway premises–Issue no. 1 was wrongly decided in favour of the plaintiff–Further, the evidence that the Estate Officer has specifically recorded the findings that the plaintiff constructed the shops in the precincts of Railway Station–Order passed by him was appealable before the District Judge and the suit was not maintainable–Impugned judgment is liable to be quashed and set aside–Suit deserves to be rejected.
