Code of Civil Procedure, 1908–Order 9, Rule 7–Rajasthan Minimum Wages Rules, 1959–Rule 30–Ex-parte proceedings–Sustainability–Proceedings u/s. 20 of the Minimum Wages Act–Rule 30 provides that the ex-parte proceedings can be set aside if the application is preferred within thirty days–Order to proceed ex-parte was passed on 19.01.2024 and application for setting aside the same was preferred on 06.02.2024–Further, the Presiding Officer has not reached to any findings as to when the notice was served to petitioner–Furthermore, the matter is at the stage of applicant’s evidence which has not been recorded–Impunged order is liable to be set aside subject to certain conditions.
