Penal Code, 1860–Secs. 420 & 406–FIR for the offence–Sustainability–Complainant engaged the petitioner for construction work which led to financial dispute–Petitioner returned the money through three cheques–Complainant failed to present the cheques or initiate the proceedings u/s. 138 of N.I. Act–He did not seek the remedy timely and when he realized that the cheques became time-barred, he filed the FIR in question–FIR is the misuse of provisions of law–Quashed.
