Code of Civil Procedure, 1908–Sec. 10 r/w. Sec. 151–Order of allowing the application–Sustainability–Respondent no. 6 sought the declaration that the sale deed in respect of the suit property is null and void–Whereas the appellants sought the eviction of respondent no. 6 and other tenants from the said property–Although the suits may be in respect of very same property but the issues which arise in both suits are quite distinct–Trial Court could have ordered for clubbing of both suits–Decree passed in the suit filed by the respondent no. 6 would have a consequential bearing in the suit filed by the appellant–Impugned order is set aside, however, the Court below is the liberty to club the suits.
