Registration Act, 1908–Sec. 49–Objection as regard to admissibility of
the agreement of sale for the reason of being not registered–Objection was negated with view that it can be used for collateral purpose–Trial Court did not discuss the issue whether a clause of the agreement to sale despite it being unregistered could be relied upon for the purpose of it’s evidentiary value as to possession on the ground of such purpose being collateral to the agreement to sell itself–When an objection to the admissibility of a document is raised, it should be decided with clarity by the reasoned order–Trial Court is directed to decide the objection afrersh by a reasoned order.
