Code of Civil Procedure, 1908–Order 18, Rule 17–Application under–Rejection of–Court below was swayed by the fact that granting of further opportunity to adduce the evidence would cause the delay in the trial–Nature of evidence which the petitioners propose to adduce would be rather relevant for the proper adjudication of the controversy pending before the Court below–The delay is not entirely attributable to the petitioners–Petition deserves to be allowed subject to payment of cost of Rs. 5,000/- to the defendants.
