Penal Code, 1860–Secs. 304A & 279–Conviction–Sustainability–Sole eye-witness of the incident admitted that no blood marks were found on the spot and on the tires of bus which was seized just after the incident–Tyre was not sent for FSL examination–He mentioned the registration number of the bus in the report P/6 but the complainant did not mention the registration number of the bus at any stage–It is not established that the accused caused the accident by the alleged bus–Impugned judgment of conviction is liable to be set aside.
